The products sold on www.desantisalvarez.com (hereinafter the “Website”) are sold and invoiced by ARIBERTO UNO S.R.L., with registered office at VIA ARIBERTO 1, 20123 MILAN, a company registered with the Milan Monza Brianza Lodi Chamber of Commerce, Tax Code and VAT No. 04311130969. GENERAL TERMS AND CONDITIONS OF SALE
1. Acceptance of the General Terms and Conditions of Sale and Conclusion of the Contract
1.1 The contract entered into between ARIBERTO UNO S.R.L. and the Customer (i.e. the individual consumer who makes a purchase on the Website for purposes unrelated to their commercial, business or professional activity) shall be deemed concluded upon ARIBERTO UNO S.R.L.’s acceptance, even partial, of the Order. In the event that the Order is not accepted, ARIBERTO UNO S.R.L. shall in any event promptly notify the Customer.
1.2 By placing an Order using the methods provided for and in accordance with the order form available on the Website (hereinafter the “Order”), the Customer declares that they have read all the information provided during the purchasing procedure and fully accept these general terms and conditions (hereinafter the “Terms”).
1.3 These Terms may be printed or saved on a durable medium, in accordance with Article 12 of Legislative Decree 70/2003 and Article 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.
2. Purchase Procedure
2.1 The products offered for sale by ARIBERTO UNO S.R.L. are exclusively those available on ARIBERTO UNO S.R.L.’s Website at the time the Order is placed, as described in the relevant product information sheets.
2.2 It is understood that the images accompanying the product description are provided for information purposes only and may not perfectly represent the characteristics of the product, and may differ, for example, in colour and size, including due to the browser and monitor used to access the Website and view the images.
2.3 To place an Order, the Customer must complete the relevant form on the Website in full and submit it after carefully reviewing these Terms, as well as the characteristics of the product or products they intend to purchase. The Customer must also request ARIBERTO UNO S.R.L., if desired, to issue a tax invoice for the purchase, pursuant to Article 22 of Presidential Decree No. 633/1972.
2.4 ARIBERTO UNO S.R.L. will confirm receipt of the Order by sending an email to the email address provided by the Customer. This confirmation message will briefly set out the applicable purchase conditions, as required by law, as well as the information entered by the Customer in the Order, so that the Customer can verify the information and, where necessary, promptly notify ARIBERTO UNO S.R.L. of any corrections to incorrect data.
3. Prices and Payment Methods
3.1 The prices indicated on the Website include taxes and VAT. Any shipping costs or payment fees will in all cases be communicated to the Customer in advance through the Website or these Terms.
3.2 The following payment methods are available:
(i) PayPal
The Customer may use the PayPal payment system to make the payment, in accordance with PayPal’s specific terms and procedures.
(ii) Credit Card
For purchases made by credit card, the transaction may be processed through PayPal’s secure server or another secure server selected by ARIBERTO UNO S.R.L.
Under no circumstances and at no stage of the payment process will ARIBERTO UNO S.R.L. have access to the Customer’s credit card information. Such information is transmitted through a secure connection directly to the website of the banking institution processing the transaction. No computer system operated by ARIBERTO UNO S.R.L. will store such data and, therefore, ARIBERTO UNO S.R.L. shall under no circumstances be held liable for any fraudulent or unauthorised use of credit cards by third parties at the time of payment.
(iii) Bank Transfer
In the event of payment by bank transfer, the relevant bank details will be displayed. The goods will be shipped only after the payment has actually been received by the bank.
4. Delivery of Products and Related Costs
4.1 The purchased products will be delivered to the address indicated by the Customer in the Order within 48–72 hours from acceptance of the Order by ARIBERTO UNO S.R.L., at the cost specifically indicated on the Website before the Order is submitted. ARIBERTO UNO S.R.L. reserves the right to accept or refuse delivery requests outside the borders of Italy or Europe. In any event, for deliveries outside Italy, shipping costs and delivery times may vary.
The products may also be collected free of charge from the De Santis by Martin Alvarez store in Milan, Via Ariberto 1, 20123 Milan. In the event of in-store collection, the availability of the products will be promptly communicated to the Customer, who will have 14 days to collect them. After this period, the return procedure will automatically be initiated.
4.2 For deliveries to countries outside the European Union, any import duties and customs charges shall be borne by the recipient. Customers are therefore advised to contact the customs authorities of their country in advance to verify the applicable costs and any import restrictions.
4.3 The delivery times indicated by ARIBERTO UNO S.R.L. are purely indicative. Any delay beyond these times, or any delivery made through subsequent partial shipments, shall not entitle the Customer to refuse delivery or to request compensation or indemnification.
4.4 Upon delivery of the products, the Customer must check:
that the number of packages delivered corresponds to the number indicated on the transport document;
that the packaging is intact, undamaged, not wet and has not otherwise been altered, including the sealing materials (adhesive tape or metal straps).
Any damage to the packaging and/or product, or any discrepancy in the number of packages or the information indicated, must be immediately noted by making a specific statement on the delivery document to be returned to the courier.
Any problems concerning the physical condition, conformity or completeness of the products received must be reported within 7 days of delivery, in accordance with the procedures set out in this document.
5. Right of Withdrawal
5.1 Pursuant to Article 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer may withdraw from these Terms and therefore from the purchase contract for any reason, without having to provide any explanation and without incurring any penalty, within 14 (fourteen) days from the date of receipt of the products.
5.2 To exercise the right of withdrawal referred to in Article 5.1 above, the Customer must send ARIBERTO UNO S.R.L. a notice to this effect within the aforementioned period by email to: info@desantisalvarez.com, or by using the appropriate return form.
5.3 In the event of withdrawal, the Customer may return the goods to ARIBERTO UNO S.R.L. within 14 (fourteen) days from the date of withdrawal, at the following address:

If the facilitated return service is used, collection will be arranged by ARIBERTO UNO S.R.L. for a fee of EUR 15, which will be deducted from the amount refunded to the Customer.
The purchased goods may also be returned directly to the De Santis by Martin Alvarez store in Milan, Via Ariberto 1, 20123 Milan, free of charge, provided that prior notice is given by email to info@desantisalvarez.com.
The goods must be returned intact, complete with all their parts and in their original packaging (bags and boxes). They must have been handled and, where applicable, used only for the time strictly necessary to establish and verify their nature, characteristics and size, exercising ordinary care and ensuring that there are no signs of wear or dirt, in accordance with the following conditions:
The right of withdrawal does not apply to products that have been personalised at the Customer’s request.
The right of withdrawal may be exercised only in relation to the product purchased in its entirety; it is not possible to exercise the right of withdrawal only with respect to part of the purchased product (e.g. accessories, complementary items, etc.).
In order for the right of withdrawal to apply, the product must be intact and returned in its original packaging, complete in all its parts (including the packaging and any documentation and additional accessories such as labels, tags, seals, etc.).
In the event that the goods are damaged during transport, ARIBERTO UNO S.R.L. will notify the Customer so that the Customer can promptly file a claim with the courier selected by the Customer and obtain the relevant compensation. The product will then be made available to the Customer, and the withdrawal request will be cancelled at the same time.
ARIBERTO UNO S.R.L. shall not be liable in any way for damage, theft or loss occurring during, or otherwise in connection with, the shipment of the returned goods.
5.4 ARIBERTO UNO S.R.L. shall refund the Customer the full amount already paid, excluding any additional shipping costs pursuant to Article 56, paragraph 2, of Legislative Decree 21/2014, within 14 (fourteen) days from the date of withdrawal. The refund will be made using the same payment method used by the Customer for the original transaction, unless otherwise agreed. ARIBERTO UNO S.R.L. may suspend the refund until the returned product has been received or until the Customer provides proof that the product has been correctly returned, whichever occurs first.
5.5 In any event, the Customer will lose the right of withdrawal if ARIBERTO UNO S.R.L. determines that:
the returned product and/or its accessories and/or its packaging are not intact;
the product is missing its original outer packaging and/or original inner packaging;
the product is missing any integral components and/or accessories (e.g. fasteners, laces, buckles, etc.).
In the event that the right of withdrawal is forfeited, ARIBERTO UNO S.R.L. will return the purchased product to the sender, charging the sender the shipping costs and, if the purchase price has already been refunded, the price of the product as well.
6. Warranties
6.1 All products sold by ARIBERTO UNO S.R.L. are covered by a 24 (twenty-four) month warranty for conformity defects, pursuant to Title III of Legislative Decree 206/2005. To make use of the warranty service, the Customer must retain the invoice or payment receipt together with the transport document.
6.2 The warranty for conformity defects shall apply provided that the relevant product has been used correctly, in accordance with its intended purpose and the instructions for use and washing provided with and/or on the product.
6.3 If, for any reason, ARIBERTO UNO S.R.L. is unable to provide the Customer with a product covered by the warranty, either repaired or replaced, or if repair or replacement would be excessively burdensome, including in view of the value of the product, ARIBERTO UNO S.R.L. may proceed with an appropriate reduction of the price paid or, alternatively, refund the entire amount paid and terminate the contract.
6.4 Where the application of the warranty requires the product to be returned, the Customer must return it in its original packaging, complete in all its parts (including packaging and any documentation and accessories supplied).

8. Privacy
8.1 Personal data collected when placing an Order will be processed by ARIBERTO UNO S.R.L. solely for the purpose of fulfilling the Customer’s specific requests, in compliance with European Regulation 679/2016 and the privacy policy available on the Website. Any further processing will be carried out only with the Customer’s express consent.
9. Applicable Law
9.1 The sales contract governed by these Terms, as well as its performance, shall be governed by Italian law, excluding conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. Any disputes arising in connection with the contract shall fall under the jurisdiction of the court of the municipality in which the Customer resides.
